A recoverable Council Tax Benefit or Housing Benefit overpayment may be recovered from:
- the claimant
- the person to whom it was paid (e.g. landlord or landlord's agent), except for certain circumstances
- any person who misrepresented or failed to disclose a material fact which resulted in the overpayment being made
- the partner of the claimant, but only in specific circumstances
