Housing benefit - overpayments

Overpayments are established through revision of benefit entitlement.  They are amounts of benefit which have been paid but to which there is no entitlement under the regulations.


A recoverable Council Tax Benefit or Housing Benefit overpayment may be recovered from:
  • the claimant
  • the person to whom it was paid (e.g. landlord or landlord's agent), except for certain circumstances
  • any person who misrepresented or failed to disclose a material fact which resulted in the overpayment being made
  • the partner of the claimant, but only in specific circumstances
Remember prompt reporting of changes in your circumstances will help prevent overpayments from occurring.
