Smoking Shelters and Planning
As a result of this legislation, owners of premises may wish to provide a smoking shelter for smokers outside the main building. Planning Permission will be required for the majority of these smoking shelters.
Planning applications of this type generally take up to eight weeks to consider. Therefore applications should be submitted as soon as possible to allow time for a decision and for the shelter to be erected. It is stressed that every planning application is considered on its merits and it should not be assumed that permission will necessarily be granted.
Smoking shelters must not be 'substantially' enclosed or they would also be deemed non-smoking by the new legislation. You should therefore seek legal advice or speak to Barry Hanley of the Council's Environmental Health Service on 01708 432767 to determine whether the shelter would be classed as 'substantially' enclosed.
The Environmental Health Service will be consulted on all planning applications of this nature.
