Liberty Protection Safeguards (LPS)
The Mental Capacity (Amendment) Act 2019 introduced a new model of authorising deprivation of liberty. The new model is called Liberty Protection Safeguards (LPS).
The Government launched a public consultation on 17 March 2022 which ended 14 July 2022.
This consultation covered the proposed changes to the MCA 2005 Code of Practice and implementation of the Liberty Protection Safeguards. Read more about the code changes.
Update April 2023: In a letter to stakeholders on 5 April 2023, the Department of Health and Social Care (DHSC) stated that the implementation of LPS has been delayed beyond life of this parliament.
