Adding a partner or spouse to your tenancy

Requests for sole to joint tenancies can be granted for a spouse, whether married or in a civil partnership.

Joint tenancies will not be granted where the request is for adding a family member, including a son or daughter or friend, as this would create a right of succession that may not exist.

If you are requesting to add a spouse to the joint tenancy, once the formal request has been received we will require:

  • confirmation that the prospective joint tenant does not have a property or an interest in a property elsewhere
  • original marriage/civil partnership certificate
  • original personal identification eg a passport, birth certificate, driving licence, of the prospective joint tenant
  • original proof of residency, covering 12 months eg a utility bill, council tax letter, bank / credit card statement, medical card, of the prospective joint tenant

If sole to joint tenancy is granted, a new fixed term tenancy will be created to be reviewed every 3 or 5 years.

In order for the joint tenancy to be granted the rent account must be clear of arrears and there must be no other debts held with Havering at the time of the request.

Adding a son or daughter be added as a joint tenant

Secure Council tenants don’t have a right to add people to their tenancy agreements. This means that sons and daughters cannot be added as a joint tenant.

There are a limited number of circumstances where someone can succeed to a Council tenancy.
