Havering Local Plan - Examination latest news and previous updates

The Havering Local Plan (2016-31) and supporting documents were submitted to the Secretary of State for the Ministry of Housing, Communities and Local Government for independent examination on 27 March 2018.

Consultation on Further Main Modifications

Examination hearings took place in October 2018 and May 2019 under the direction of a Planning Inspector (Ms Susan Heywood BSc (Hons) MCD MRTPI).

A consultation on Main Modifications was carried out in September/October 2020, the comments received were considered by the Council, responded to and published.

They will be taken into account by the Inspector before she reaches her conclusions on the soundness of the plan.

The Council and the Inspector are now undertaking further work aimed solely to ensure Local Plan conformity with the new London Plan (2021).

The proposed Further Main Modifications to the Local Plan

The Inspector considers that the Local Plan could be found ‘sound’ subject to it including a number of Further Main Modifications. These are identified in the FMMC01 Schedule of Proposed Further Main Modifications (2021) (see above).

The proposed Further Main Modifications are put forward without prejudice to the Inspector’s final conclusions regarding the soundness of the Plan. All representations (comments) made on the proposed Further Main Modifications during this consultation period will be fully taken into account by the Inspector before she reaches final conclusions on the Plan.

There are no further changes proposed to the Proposals Map.

Updates to the Local Plan Sustainability Appraisal and Habitats Regulations Assessment Addendums

The Inspector is also inviting comments on the commentary in the Sustainability Appraisal and Habitats Regulations Assessment Addendums which consider the changes proposed in the Further Main Modifications.

This latest work also takes account of comments made during the earlier consultation(s) and at the Examination hearings.

Parts of the Local Plan which have not changed

This consultation only deals with the proposed Further Main Modifications, and the updates to the Sustainability Appraisal and Habitats Regulations Assessment Addendums and Housing Supply Statement 2021 as set out above.

The rest of the Local Plan is no longer open for comment and any comments not related to the proposed Further Main Modifications, or Sustainability Appraisal and Habitats Regulations Assessment Addendums and Housing Supply Statement 2021 will not be taken into account.

If you have already submitted comments on the Local Plan then there is no need to repeat these or re-submit them as they have already been considered and published as part of the examination process.

Comments on the proposed Further Main Modifications should focus on whether you think the proposed Further Main Modifications are necessary to make the Local Plan ‘sound’ (including legally compliant) as required by paragraph 20 of the Planning and Compulsory Purchase Act 2004.

The National Planning Policy Framework (2012) explains that to be ‘sound’, Local Plans have to be positively prepared, justified, effective and consistent with national policy (paragraph 182).

For information, it was agreed at the initial Local Plan Examination hearings in October 2018 that the Local Plan would be considered under the transitional arrangements set out in paragraph 214 of the National Planning Policy Framework (2019).

Comments on other aspects of the submission version of the Local Plan will not be taken into account and will be disregarded.

This consultation is open to everyone and is not restricted to those people or organisations that made representations during previous stages of the plan.

Unfortunately late comments cannot be accepted. Anonymous comments will not be accepted.

What will happen to your comments

our comments and name will be published and made available to the Planning Inspector following the consultation. However, personal information, such as addresses, phone numbers and emails, will be kept confidential.

Your comments will be forwarded to the Inspector who will take all comments on the proposed Further Main Modifications into account before determining whether any of the Further Main Modifications are necessary to make the submitted Local Plan sound.

Next steps

Having considered all responses to the proposed Further Main Modifications, the Inspector will finalise her report into the soundness of the Local Plan and the schedule of recommended Main Modifications and Further Main Modifications. The Inspector’s report is expected later this year.

If the Inspector finds the Local Plan ‘sound’ and legally compliant, the Council expects to formally adopt the Local Plan in November 2021.

June 2021 update

The Council has received further correspondence from the Inspector regarding conformity with the London Plan and the Council has responded.

The Council continues to work with the Inspector to finalise matters regarding conformity with the new London Plan.

06 November 2020 update

In August, the Council published Main Modifications for consultation, this consultation has now closed.  The Council will now record and consider the comments received.

The Council proposed a number of additional ‘minor’ modifications (e.g. typographical errors, clarifications and factual updates) to improve the clarity of the Local Plan.

None of these changes materially affected the policies of the Local Plan and they were outside the scope of the consultation.

2 December 2019 update

The Council is working with the Inspector to finalise matters for the consultation on the Main Modifications which is currently scheduled to begin in Summer 2020.

The Council is inviting comments on Local Plan Revised Policy 11 – Gypsy and Traveller and Show People Accommodation, including the proposed Site Allocations ahead of the Local Plan examination on 29 and 30 May 2019.

15/04/2019 - Inspectors matters, issues and questions

The Inspector has now issued her ‘Matters Issues and Questions’ for the upcoming Local Plan Examination 29-30 May 2019, along with Guidance Notes, a letter for the Council and a draft timetable for the May hearings.

Examination May 2019

The Havering Local Plan (2016-31) and supporting documents were submitted to the Secretary of State for the Ministry of Housing, Communities and Local Government for independent examination on 27 March 2018.

The examination took place between Tuesday October 9 2018 and Thursday October 18 2018. Further details are in the 'Examination Correspondence' section below (items IED004, IED005, IED006 and CED004).

Following the hearings into the examination, the Inspector had some follow on queries regarding specific issues relating to various matters discussed at the hearing Further details on this and the Council’s initial response are in the Inspector’s 'Post Hearing Correspondence' section below (items IPHD001, CPHD001, IPHD002, CPHD002).

The reconvened examination is due to take place on Wednesday 29 and Thursday 30 May (Notice of Local Plan Examination). The inspector expects to advise of revised matters and issues and guidance notes by 16 April.

The Inspector would request statements back from parties (which may include the Council) by Thursday 16 May.

The Planning Inspector

Inspector Susan Heywood BSc (Hons) MCD MRTPI has been appointed to conduct the examination into the soundness of the London Borough of Havering’s Local Plan.

The Programme Officer

The Programme Officer, Andrea Copsey, will act as the contact for any person who has an interest in the examination and as a liaison between the inspector, council and representers.

The Programme Officer is an independent officer of the examination and works on behalf of the inspector to organise and manage the administrative and procedural matters of the examination process. Andrea Copsey is the appropriate point of contact for any questions relating to timetabling or procedural matters.

Any matters that anyone wishes to raise with the inspector should be submitted via the programme officer.
